TUF 10 Contestant, Zak Jensen, Named in Wrongful Death Lawsuit

Zak Jensen has been named in a wrongful death suit from a family in Minnesota.

The Stillwater Gazette offers some details of the suit,

Relatives of a Stillwater Area High School graduate who died in Mexico under unclear circumstances say they are just looking for justice and details about his death by filing a lawsuit against those who saw him last.

Elizabeth Gunderson Koll filed the suit Thursday in Washington on behalf of her son, Josh Gunderson. The suit accuses Zachery Jensen, Jason Jones and Sterling Systems, which is owned by Jones, of negligence in Josh Gunderson's death.

Gunderson died during a March trip to Puerto Vallarta, Mexico, with Jensen and Ashley Jones. Jensen, who is now appearing on SpikeTV's 'The Ultimate Fighter," was working for the Jones family as a bodyguard.

Never a good sign when you are working as a bodyguard and your charge dies.

Mexican authorities concluded that Gunderson slipped and hit his head. Family spokesman Brian Gunderson, Josh's uncle, said in March that preliminary evidence from an independent autopsy that the family commissioned also indicated that the death was an accident.

Since that time, the family has received all the investigation documents from Mexican authorities and had time to translate them. Those documents suggest the death wasn't an accident, said lawyer John D. Magnuson Magnuson, who later added that he was unhappy with how the Mexican investigators handled the death.

For those that read the entire article it feels a little lacking in some of the details of the incident in question.

Luckily the local ABC affiliate adds more to the story.

An autopsy ordered by the family shows Gunderson had wounds to his face, and that he ultimately choked on his own vomit. The medical examiner says that could have happened because of a struggle.

The concierge at the Sheraton Hotel told authorities Jensen said "I just defended myself. He was attacking me." They claim he also said "he shouldn't be with her. He was liking her and she didn't."

Wow, Jensen's alleged comments at the hotel imply that some confrontation occurred.

Zach Jensen had no comment either. But his parents did share their thoughts.

"Alcohol was the responsible party here, way too much alcohol. That should be the focus," said Karen Jensen.

Medical reports show Gunderson had a blood alcohol level of .12.

"Zach did the right thing. He was Dudley Do-Right as he has been his whole life. He stayed there," said Bob Jensen,

Yikes. 

The whole situation is very messy and WKR will wait for the legal process to play itself out.

That being said, there is a saying that "nothing good ever happens at 3:00am." WKR would like to amend that to, "nothing good can happen when you mix alcohol, a girl, a bodyguard all while in Mexico."
